Minimum Advertised Price (“MAP”) Policy
1. INTRODUCTION
REC-COM Outdoors Operating US, Inc. (“REC-COM”) has unilaterally established the following Minimum Advertised Pricing Policy (“MAP Policy”) for certain products (“MAP Products”) sold or distributed in the United States. REC-COM believes that the MAP Policy is necessary to: (i) maintain the premium reputation for its high-quality products, which is the direct result of REC-COM’s significant investments in top-line design, innovation, and engineering; (ii) preserve its products’ brand image; and (iii) ensure distributors and retailers provide effective marketing and technical support. REC-COM firmly believes that this MAP Policy will maximize new product introduction success and overall competitiveness throughout
its various sales channels.
This MAP Policy is effective as of February 1, 2026, and it supersedes all prior REC-COM
MAP policies.
All Resellers, including Authorized Resellers as defined in the Retail Supply Agreement and Distribution Supply Agreement, who wish to sell MAP Products will be required to comply with the MAP Policy.
2. SCOPE
The MAP Policy and current list of MAP products can be found at: https:// reccomoutdoors.com/map-policy
Under the MAP Policy, MAP Products may not be advertised at a price below the Minimum Advertised Price (“MAP”) established by REC-COM and posted on the REC-COM website identified above. This covers all advertisements of MAP Products in any and all media, including, without limitation, flyers, posters, coupons, mailers, in-store price tags or displays, inserts, newspapers, magazines, catalog, mail order, internet/e-commerce or similar electronic media including websites, email newsletters, email solicitations, television, radio and public signage. However, the MAP Policy does not apply to pricing displayed only on non-public, e.g.
password-protected, sites.
The MAP Policy applies only to the advertising of new products. Products returned by customers
that can no longer be sold as “new” and are clearly marked as such (e.g., “open box,” “refurbished,” etc.) are not subject to the MAP Policy.
THE MAP POLICY APPLIES ONLY TO ADVERTISED PRICING. IT DOES NOT APPLY TO ACTUAL SALES PRICES. RESELLERS REMAIN SOLELY RESPONSIBLE FOR SETTING THE PRICE AT WHICH THEY SELL ALL PRODUCTS.
REC-COM will inform Resellers if and when a MAP expires for any MAP Product. Expiration will remove all MAP requirements for the specified MAP Product. REC-COM reserves the right to modify the MAP Policy, list of MAP Products and/or MAPs at any time and for any reason and will inform Resellers in writing of any such changes.
It is a violation of the MAP Policy to sell MAP Products to customers who advertise MAP
Products in violation of this MAP Policy.
3. ONLINE SALES
Pricing listed on an internet site is considered an “advertised price” and must adhere to the MAP Policy. Once the pricing is associated with an intent to purchase (added to the shopping cart or order), the price becomes the selling price and is not bound by the MAP Policy.
Certain common internet marketing practices are NOT acceptable under the Map Policy. For example, statements such as “Discounted Prices”, “XX% off” or “$XX off,” “On Sale” or MAP prices with a strikethrough are not permitted.
Website features such as automated “bounce – back” pricing e-mails, pre-formatted e-mail responses, forms, automatic price display for any items prior to being placed in a customer’s shopping cart, display of in-cart pricing through use of “hovercarts” and other similar features constitute “advertising” under the MAP Policy. Any prices shown in such features must comply
with the MAP Policy.
Unless REC-COM gives prior written approval, MAP Products may not be sold or offered for sale on any third-party website or marketplace. A “third-party internet website or marketplace” is any website that is not owned and controlled by REC-COM or an Authorized Reseller, and which provides a virtual “storefront,” auction process or any other sales opportunity (e.g.
consignment) under the name or brand of a third party or co-branded with a third party (including by way of example Amazon.com, eBay, Jet.com, Walmart.com).
Sales to any internet reseller that sells, or intends to sell, MAP Products on any third-party website or marketplace are strictly prohibited. To assist Resellers in complying with this requirement, REC-COM may from time-to-time issue a list of known resellers to whom sales are prohibited. Note, however, that consulting any such list does not end or limit the Reseller’s
obligations in identifying prohibited resellers prior to the sale. Resellers aware of REC-COM’s policy will likely be creative in their attempts to get the products they want, so review of a prohibited resellers list is only one step that should be taken to ensure compliance with the MAP Policy. Any such list is intended by REC-COM to be used by Resellers as a reference tool only
and does not prevent the reseller from being found in violation of the MAP Policy.
4. EXCEPTIONS
The following types of advertised promotion are not considered violations of the MAP Policy:
-
Advertisements displaying price that complies with the MAP Policy but also offering free financing or “no layaway charge
-
Free shipping
-
Free wrapping or gift card
-
Awarding free store product (that is not otherwise a MAP Product) with the purchase of the MAP Product
-
Storewide or category-wide price promotions (e.g., 10% off everything in the store, provided that there is no special attention drawn to MAP Products in the advertisement)
-
Discounts on MAP Products that have been discontinued.
-
The MAP Policy does not in any way limit the ability of any Resellers to advertise that “they have the lowest prices,” that they “will meet or beat any competitors price,” that consumers should “call for a price,” or phrases of similar import.
-
Statements such as “add to basket to see price,” “we will match any price,” “call for price” or phrases of similar import are acceptable as long as the price advertised or listed for the products is not below the MAP Price.
-
Discounts applied at checkout to the entire order based on a customer’s purchasing history with the reseller, such as discounts for “frequent shoppers” or those that belong to a “buyers’ club” do not violate the MAP Policy.
-
Store-wide discounts on all store or site items or “all on sale” promotions, so long as such promotions are for a limited time (e.g. Black Friday, Cyber Monday, anniversary sale, etc.) and REC-COM products are not separately identified.
-
It is permissible to include in any advertising an additional discount, coupon, gift card, or incentive (whether in the form of a product, special event, promotion, term of doing business or otherwise) that translates into an immediate price reduction unless the cumulative effect would be to reduce the advertised price of any MAP Product below the MAP.
o For example, offering a free or discounted product with the purchase of another product at regular price (so-called “Buy One Get One” or “BOGO” type sales) are permitted so long as (a) the free or discounted product is not a MAP Product and
(b) the total advertised price for all of the products included in the promotion is
not lower than the combined MAP of those products.
